  1. General

  2. 1.1 The Shoppers Corner website ("Site") is located at www.shopperscorner.com.au. The Site is operated by Woolworths Limited (ABN 88 000 014 675).

    1.2 Your access to and use of the Site is governed by these terms and conditions ("Terms"). By using the Site, you agree to the Terms. If you do not agree with any of the Terms, you should not continue to use the Site.

  3. Purpose

  4. 2.1 The Site allows you to complete various market surveys, forums, polls and competitions.

  5. Registration

  6. 3.1 You must register for the Site in order to use the Site and be eligible to win prizes. You must ensure that you provide full, complete and valid registration details during the registration process for the Site. You must keep these details updated.

    3.2 Once registered, you will become a member of the Site ("Member"). You must not have more than one active membership to the Site.

    3.3 We may ask you for additional information from time to time.

  7. Forums

  8. 4.1 You may be able to access and participate in various forums on the Site. You must ensure that your participation in the forums is consistent with the Acceptable Use Policy set out below.

  9. Surveys and Quick Polls

  10. 5.1 You will be invited from time to time to participate in various market surveys and polls. We may send invitations to complete surveys to the email address nominated in the registration process. You consent to receiving these emails.

    5.2 You must ensure that your participation in market surveys and quick polls is consistent with the Acceptable Use Policy set out below.

  12. 6.1 We may, from time to time, offer incentives to encourage you to use the Site. This may include the awarding of prizes ("Prizes").

  13. Availability and liability

    1. the Site is provided "as is" and we do not warrant or represent that it is complete, current, free from errors or omissions, programming bugs, viruses or secure;

    2. the availability of the Site may be subject to numerous factors, including those outside of our control (such as malfunction in equipment and software, Internet access difficulties or delay or failure of transmission). Accordingly, we do not warrant or represent that the availability of the Site is continuous or uninterrupted.

    7.2 Except as provided in clause 7.3, we exclude all:

    1. warranties whether express, implied, statutory or otherwise, relating in any way to this Site and your use of this Site; and

    2. liability (including for negligence) to you or anyone else in respect of any loss or damage (including special, indirect or consequential loss or damage such as loss of revenue, unavailability of systems or loss of data) arising from or in connection with any use of this information on or access through this Site for any reason whatsoever (including negligence).

    7.3 Where any law implies in this agreement any term, and that law voids or prohibits provisions which exclude or modify the operation of such term, then the term is taken to be included in this agreement. However, our liability for breach of such term will be, if permitted by law, limited to the resupply of the services; or the payment of the cost of resupply.

    7.4 Nothing in these terms and conditions is intended to limit or exclude any liability that cannot be excluded by law.

  16. 8.1 This website and the material contained in it (including without limitation the data, software, design, text, graphics and any copyright work) are owned by or licensed to us or our related entities (unless otherwise specified), and are supplied solely for reference purposes.

    8.2 Apart from private, non-commercial use permitted by these terms and any use permitted under the Copyright Act 1968 (Cth), you must not reproduce, reuse, transmit (including broadcast), communicate, adapt, distribute, sell, modify or publish or otherwise use any of the material on this site (including any underlying source code, data, listings or maps), for any purpose whatsoever without our written permission.

    8.3 You must not, whether through the use of additional software or by any other means (including, for example, spiders or bots), data mine or conduct automated searches on this website or the material contained on it, nor take results generated from this site and reformat and display them.

    8.4 You must not use any of the content on this site for commercial purposes or to establish or operate your own product or offering.

    8.5 Despite the preceding paragraphs, we may from time to time allow web-crawling technology of internet search engine providers to access this website. If you are an internet search engine provider with this access, you may use your web-crawling technology to index the content on this website for the sole purpose of returning links to this website in your search results in the ordinary course of operating your search engine service.

    10.2 We will collect your personal information through the information you provide through the Site, your use of the Site, or through your personal contact with us. We collect and disclose your personal information:

  23. Termination

  24. 12.1 You may cancel your membership of the Site at any time.

    12.2 We may immediately limit, suspend or cancel your access to and use of the Site and your membership of the Site if:

    1. there is an emergency or we need to perform maintenance on the Site;

    2. you are in breach of these terms and conditions, or where we reasonably believe that you are in breach of the Acceptable Use Policy; or

    3. you have not, in our reasonable opinion, actively used or participated in the Site for a reasonable period of time.

    We will not notify you if we cancel your membership to the Site. However, if you would like reasons for your termination, we will provide these to you on request.
    12.3If you cease to be Member you will no longer be eligible to use the Site or win Prizes. For clarity, if you were entered into any prize draw before you ceased to be a Member you will still be eligible to win Prizes in accordance with the terms and conditions of that prize draw.

  25. Miscellaneous

  26. 13.1 The Site has been prepared in accordance with Australian law. We make no representations or warranties as to whether or not the information or services available from the Site are appropriate for use in other countries, or comply with the laws of other countries. If you choose to access this Site from outside Australia, you do so at your own risk and you are responsible for compliance with applicable local law.

    13.2 The Site may contain links to external websites that are not operated by us or our related bodies corporate. These links are provided for your convenience only and:

    1. we make no representations or warranties, or have any responsibility or liability for those websites; and

    2. these links do not indicate, expressly or impliedly, that we endorse the site or the products or services that are provided at those sites.

  28. 14.1 We may change these Terms at any time and will notify you of such changes by posting an updated version of these Terms on the Site. You are responsible for regularly reviewing these Terms and if you use this Site after such changes are published, such use will constitute your agreement to such changes.

  29. General

  30. 15.1 If the whole or any part of a provision of this agreement is void, unenforceable or illegal in a jurisdiction it is severed for that jurisdiction. The remainder of this agreement has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected. This clause has no effect if the severance alters the basic nature of this agreement or is contrary to public policy.

    15.2 This agreement is governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of that place.
